Boundary County Prosecuting Attorney James F. Lyons asked a Bonners Ferry court to rule on the constitutionality of the Model Penal Code burglary statute in a first degree burglary case. Lyons says a pretrial ruling will save time and money by avoiding a full trial if the statute is invalid.
The Idaho House Tax writers move to reintroduce a vetoed income tax bill and propose two other measures plus a one percent spending cutback to balance a 137 million general fund budget. The plan includes disallowing the federal tax credit on state income taxes to generate 3.2 million net next year and potential tweaks to keep out of state competitors. A second bill to raise net 2.8 million in income tax revenue is under study, while a one percent cutback in all general fund appropriations except public schools could save about 895 thousand. Governor Andrus vetoed the initial tax bill, saying it fell short of balance.
Gov Cecil Andrus signed a state Farm Labor Act saying it will bring security and confidence to Idaho residents. He had vetoed a prior re enactment bill, appointed a five man committee, and the measure passed both houses without changes amid warnings of a precarious farming season.
Two Kootenai County legislators, Reps Robert M. Haakenson and Larry Looney, face recall petitions filed with the county clerk. Elizabeth J. Mathes of Coeur d'Alene began collecting signatures after voters rejected a pay raise in 1970. She aimed for 1,420 valid signatures, reporting 1,738 collected by last November 1.
The Idaho House approved the old criminal code bill 47 to 20 after a debate disruption. A second vote widened support while the revised new code was rejected 31 to 37 and sent to the Ways and Means committee. Rep Wayne Loveless was found piping debate to Boise radio station KATN, leading to a temporary halt and shutdown of telephones to outside lines.
The Idaho State Senate approved 31 to 0 a 552 979 Permanent Building Fund grant for North Idaho College adding to earlier appropriations to finish an 876 000 science building on the Coeur d Alene campus. Construction begins December 1972 with bids sought next fall.
The Idaho Department of Highways released a northern Idaho road restrictions report via Bonner County Sheriff Robert H. Wilcox. US 95 is open to all legal loads to Copeland but restricted Copeland to Eastport. SH 2 from Lardpoint to Dover is open. SH 200 remains restricted.
