Injunction Denied in Teton Dam Project Case

Federal Judge Taylor denied a preliminary injunction sought by environmental groups against the Lower Teton Dam Project. He ruled no progress would occur on the site for more than a year and found no material or irreparable harm likely in the 15 month period. The decision noted arguments over standing and the agencies' compliance with the National Environmental Policy Act and congressional authorization. Environmental groups may appeal or seek a merits review while bids earlier opened at 39.5 million dollars from Morrison Knudsen Co and Peter Kiewit Sons.
