Appeals Court Reverses O Neil Habitual Offender Ruling
The New Mexico Court of Appeals overturned a Bernalillo County District Court decision dismissing a habitual offender information against Danny O Neil of Albuquerque. O Neil, convicted in 1976 for robbery false imprisonment and second degree criminal sexual penetration linked to a St Josephs Hospital incident, faced consecutive sentences of 13 to 65 years. His companion Lucille Marie Lopez O Neil was convicted of robbery and false imprisonment with concurrent terms. The district attorney had charged O Neil as habitual based on prior San Juan County and Valencia County offenses, while a district court hearing questioned whether his San Juan County guilty pleas were voluntary and noted destruction of the San Juan record.

Avelino Gutierrez, Plaza del Sol board chair, says loans approved by former president to Robert L Goodwin and his companies were not approved by the loan committee and grievously hurt the bank. Hernandez faces four fraud counts over loans and overdrafts totaling over 1.1 million dollars. Goodwin, who pleaded no contest to one charge, is set to testify later this week.
