Retrial Ends With Lower Award In Beaver Man Suit
W. J. Hopkins of Beaver received 2500 dollars after a federal jury retrial against C. E. Whalen Co. of Walton Kentucky. A January 1971 verdict had awarded 20000 dollars but the state supreme court ordered a new trial. Hopkins contends debris in Pond Fork caused flooding damaging his truck on March 6 1967. He suffered knee back and neck injuries and income loss. Whalen argues the storm and strip mining caused the flood and disputes the truck being catapulted into the stream.
