Justices Decline To Ban Rehearing Of Wyoming Suit
PINEVILLE The State Supreme Court declined to stop a scheduled rehearing of a suit brought by H. E. Lilly, Arthur Ritz Kingdon, and Frederick T. Kingdon doing business as Barker Heights Development Co. in Wyoming County. The trio sought a show cause rule against Judge Robert M. Worrell and George W. Milam. The case concerns a cloud on title to 189 acres in Barker's Ridge and Slab Fork Districts. Milam, absent at first, later appeared and asked the February decree be set aside. Worrell granted the rehearing. Lilly and the Kingdons argue Worrell acted without jurisdiction in setting aside the decree.
