Mental Patient Can't Be Sued By High Court
West Virginia Supreme Court ruled that a default judgment cannot be entered against a person confined to a mental hospital. The opinion, by Judge Thornton Berry, reversed the Cabell Circuit Court which had dismissed a motion to substitute a duly appointed committee for Samuel Damren Jr. of Huntington in a $20,000 loan suit from Chandos Inc. The court noted the defendant was declared incompetent on March 22, 1965 and not known to be confined when ordered to appear. The ruling emphasizes representation by guardian or committee for default actions against incompetent defendants.
