Oak Hill merchant defies cigarette price law
Morris Wender faces state action for selling a carton of cigarettes at 2.39, below the 2.53 minimum set by a 1961 law. His store license was suspended 20 days last month for the same violation and he awaits a Tax Commissioner appearance. Wender will be represented by Pat Hamilton and cites a constitutional challenge to the minimum price act, recalling a GE fair trade case with Judge Ben Moore.
