Dog attack case tied to Montoya Morris leads to postponement of sentencing

Timothy Rose then appointed judge in the 10th Judicial District. Montoya and Morris face formal sentencing later. Montoya released last week but must report to the Adult Probation and Parole Office and obey conditions. A bench warrant followed her April dog incident at Tucumcari Animal Hospital where a dog died. Montoya had several dogs at home in October 2023, violating prior orders. Morris must undergo up to 60 days of diagnostic evaluation by the New Mexico Corrections Department. Public defenders are Brett Phelps and Anna Aragon. Plea agreements came after felony child abuse charges involving a young boy with bruises and a facial laceration. Police tied one dog to Montoya after a February encounter with Hartt’s mortally wounded body. officers noted blood and Montoya’s admission of five dogs at home, with two escaping and one becoming more aggressive. Both denied dog charges and face trial this fall. The attack drew nationwide attention, spurring local debate on stray dogs and nuisance laws amid a stalled city effort and a retiring city manager.
