Younger backs death penalty California seeks reconsideration
California Attorney General Evelle Younger asked the State Supreme Court to rehear its Feb. 18 6 1 ruling outlawing the death penalty urging respect for separation of powers. He argued the court erred by basing its decision on the state constitution while a federal issue remains before the U.S. Supreme Court. The petition criticized the court for deeming lengthy pre execution confinement cruel and for adopting evolving standards over societal views, noting a prior ruling by most of the current justices found the penalty not cruel or unusual. The petition was submitted by Younger and senior assistants. The Feb. 16 decision spared 107 condemned inmates, expanding California’s death row and fueling anti death penalty efforts nationwide.
