Tax ruling could be far reaching for tenants of gov facilities
A Superior Court judge in Long Beach ruled possessory interest taxes on tenants without exclusive use of government facilities illegal. Jonah Jones, owner of a 46 foot pleasure boat, argued the 1971 tax code change bars such taxes. The decision may affect hundreds of tenants with preferential agreements and nonexclusive access, including a pending K Lines case in which $168000 in taxes is challenged. The ruling could influence county officials and harbor authorities amid appeals and future disputes.
