Challenge to State Railway Commission over Newman Grove Job
Attorneys for Northwestern railway challenge the state commission’s authority to meddle with station staffing at Newman Grove and order the return of a discharged helper. They argue employment of railroad workers falls outside the commission’s jurisdiction and contend reinstating the man would force others to take over his duties. The railroad claims the commission’s power to regulate service and facilities is limited and that forcing rehire would be unconstitutional.
