Regulators Not Owners Supreme Court Case On Rail Transfers
The U S Supreme Court ruled after thirteen years that regulation cannot deprive a rail company of its property without just compensation. It held that a forced 5 cent fare split between firms did not cover costs and that the state cannot require operations at a loss over actual cost. The court emphasized that broad regulatory power does not grant ownership rights.
