Supreme Court sets high care standard for gun owners
Kansas Supreme Court ruled gun owners must exercise the highest degree of care to avoid liability in gun accidents. The 5-2 decision in the Sarah Wood case remanded for a new trial, citing instructional error by the judge and noting firearms are inherently dangerous instrumentalities. The majority upheld a stricter standard despite a dissent arguing near absolute liability.
