Judge Allows Ballot of Constitutional Amendment to Make Legislature Partisan
District Judge Emer Scheele orders the constitutional amendment onto the general election ballot after ruling that signature irregularities cited by the secretary of state do not invalidate enough names. The ruling centers on 79 ditto-marked signatures and 456 wives’ signatures using husbands’ names, adding to 46,303 validated names to surpass the required 10 percent threshold. The decision cites North Dakota and Michigan cases and leaves no appeal anticipated as the legislature remains nonpartisan since 1937.
