Texas tort reform shows little impact on Medicare costs
A Texas study by UT law professor Charles Silver and colleagues from Northwestern and Illinois found no evidence that capping noneconomic damages in medical malpractice cases lowered Medicare costs in Texas from 2002 to 2009. The 2003 Proposition 12 capped noneconomic damages at 750000, with 250000 from doctors and 500000 from hospitals, while actual damages remained uncapped. Supporters claimed fewer suits and lower premiums would follow, and doctors moved to Texas. Perry's office calls reform a huge success. The article notes low voter turnout and the mid September election date.
