Court nixes divorcee rights to military retirement funds
The Supreme Court rules 6 3 that divorced women cannot receive a share of ex husbands military retirement pay, deferring to Congress on military affairs. The decision also limits punitive damages in civil rights cases and denies jury trials to federal age discrimination suits. Justice Blackmun notes Congress must decide retirement pay sharing, while Chief Justice Burger and Justices White Marshall Powell Stevens join the majority. The ruling overturns a California ruling granting Patricia McCarty nearly half her ex husbands retirement benefits.
