Waste Control suits back to state court over anti trust clash
Waste Control Specialists and Envirocare of Texas remain in a battle over where a 1998 antitrust suit should proceed. A 5th Circuit order required Envirocare to reimburse WCS’s attorney fees while both sides tease motions for rehearing as they push for the case to stay in federal or move to state court, with officials urging an end to years of legal wrangling and costly proceedings. The dispute centers on WCS’s license to store and process radioactive waste and whether Envirocare’s actions impeded that effort.
