High Court Moderates Decisions Shaping Criminal Rights
The Supreme Court, in its seventh Burger term, limited federal review of state criminal convictions for illegal searches and narrowed the exclusionary rule. Powell stressed avoiding windfalls for the guilty, while Brennan and Marshall urged stronger Fourth Amendment protections and White favored a looser standard. The court also widened police powers in several Fourth Amendment rulings and ordered resentencing for 43 Death Row inmates in NC and LA, and overturned Oklahoma’s capital punishment law.
