Can Be Convicted Of Stealing From Spouse
In Maryland a wife can be convicted of stealing from her husband. Chief Judge W. Conwell Smith ruled in a Baltimore Criminal Court case that Audrey Delores Mohr, charged with larceny or embezzlement of 39621 from her husband Carl R. Mohr, may be prosecuted. The court rejected a common law unity defense citing the Married Woman's Act of 1898. Mohr, a former cashier in the husband’s auto business, now faces trial. Two arrests were docketed: Oliver Smith and Walter Gorman for disturbing the peace. Smith posted 5 dollars and costs, Gorman 85 and costs.
