Magistrate Ash Denies Certiorari In Stunkel Drunk Driving Case
Magistrate Joseph J. Ash of Emmitsburg responded to Charles M. Stunkel’s petition for a writ of certiorari claiming the Stunkel case, in which he was convicted of drunken driving, was illegal. Ash argued Stunkel did not pursue an appeal as allowed by law and that certiorari would not lie to review a matter where an appeal exists. The magistrate maintained his trial jurisdiction and that the petition seeks merit review rather than magistrate jurisdiction.
