New Trial Ordered For Condemned Negro
Annapolis AP The Court of Appeals on Friday ordered a new trial for Johnnie Brown a 37 year old Negro. The high court ruled the circuit judges in Dorchester County should have questioned jurors about racial prejudice that might affect their verdict. The ruling reversed a first degree murder conviction for the shooting of Salisbury patrolman Henry T Stephens in a Salisbury alley on Sept 4 1958. Stephens was shot in the back while escorting Brown to the police station after Brown was arrested on forgery and passing a worthless check. Brown testified his gun discharged accidentally as he tried to discard it. State witnesses placed him fleeing the alley with the gun. The case was moved from Wicomico County to Dorchester County and presided by Chief Judge W Laird Henry Jr and Associate Judge Rex A Taylor.
