Three Are Sentenced To Three Years In Prison
Three young men from Charles Town West Virginia with prior records were found guilty of assault and battery on a 110 year old man and his son Roy Hurt 65 in an alley off South Market Street. Justice Wilbur F Sheffeld sentenced the four defendants to Maryland House of Correction for three years each on the two charges. One 16 year old accomplice received a suspended sentence. The victims testified they were knocked to the ground and robbed of eight dollars. Det Sgt A Norman Dietz testified for the prosecution. The defendants were Lewis H Smeltzer James A Hough Robert L McDonough and Clarence W Kidwell all from Charles Town. E Austin James testified for Kidwell. Kidwell had no prior record while the others have detainers for breaking and entering and larceny. The magistrate found Frank Sheppherd of Charles City guilty of exceeding 30 mph but suspended fine due to extenuating circumstances and first offense. He was cited for transporting a mentally sick person. Found not guilty of overweight trucks were Ralph F Carey and Kenneth R Beachy. Carey was represented by Alton Y Bennett.
