Appeal Filed Over Canal Decree Stay

The Attorney General of Maryland filed in the Circuit Court at Hagerstown an appeal from Judge Stake’s decree postponing the Chesapeake and Ohio Canal sale to January 1, 1906. The state argues the decree would transfer the canal to 1914 bondholders extinguishing the state’s waterway interest, a view not shared by a 4-3 Court of Appeals split.
