State to Appeal Gas Tax Decision

Baltimore May 4 The state will appeal a Anne Arundel county circuit court ruling that ordered a referendum on the November gas tax of one and one half cents. Attorney General Thomas Robinson filed the appeal to the Court of Appeals after a conference with Governor Ritchie. Judge Moss had found the levy subject to a referendum, overturning a prior view that it could not be voted on after passage. The Appellate Court will hear arguments later this month and a decision is expected by mid June before the general election. The ruling held that funds go to the State Roads Commission, giving it control over expenditures with no county input.
