High court weighs HIV disability in ADA case
The Supreme Court weighs whether HIV infection constitutes a disability under the Americans with Disabilities Act in a dispute over medical discrimination. Bragdon argues a Maine dentist may refuse treatment based on risk, while Abbott urges full ADA protection for HIV status. Justices debate if infection creates a "substantial" life activity limit and consider implications for other conditions. The decision could clarify when direct threats justify differential treatment and affect future disability rulings. The case coincides with other terms on federal crime powers and public access issues.
