Charles W. Marker, 57, prominent resident of Lantz, was acquitted by Judge Stedman Prescott in Circuit Court on a charge of failing to stop after a fatal March 1942 accident. The State argued Marker struck Charles Anthony Toms on the Smithsburg Foxville road. Marker testified he heard noises in the car and found nothing. Testimony noted blood spots 120 feet from the scene suggesting drag marks. Marker had inconsistent stops, later took Toms to Hagerstown. Marker testified he worried he might have caused the death. he denied stopping near a stable. Bowens Sentenced After Guilty Plea.
