The News Frederick reports that on a Thursday in March 1931 Collaza faced his fate as jury foreman Mrs. Margaret Teachout delivered an apparently unshaken verdict. Collaza, smiling and confident, whispered to his wife Rosa as he was led back to jail.
A federal jury in Washington found Oscar Collazo guilty on two counts of first degree murder and two counts of assault with intent to kill for the November 1 attack on President Truman's residence. The jury imposed the automatic death sentence on each murder count, though the actual lethal bullet was fired by accomplice Griselio Torresola.
Mrs Collazo told reporters she had no statement to make Leo A Rover head of Collazo s court appointed counsel said an appeal will be filed within five days for a new trial. Mal sentencing not expected until after the motion is disposed of. Appeals then go to the Circuit Court and likely the Supreme Court if the first appeal fails.
Testimony shows Collazo fired nine times in the melee while Torresola shot Coffelt and Downs, wounding Birdzell and Coffelt fatally in a Blair House incident. Coffelt shot Torresola before dying. Collazo was wounded but recovered. Final arguments labeled lack of murderous intent.
The witness said the pair did not intend killing and the Puerto Rican nationalist denounced U S rule in the island. He blamed the shooting of fellow Nationalist Party members on the U S Government while testifying in a case tied to colonial tensions.
