Judge Allow Negligent Death Suit Against Ambulance
In a four page ruling Circuit Court Judge William W Wenner rejected defense attempts to dismiss a three count negligent death suit filed by Connie J Peresada over the May 1985 death of her husband Alexander T Peresada. The judge did dismiss punitive damages claims against Francis X Elder American Legion Post 121, citing charitable immunity. The suit, brought in Emmitsburg, names Emmitsburg Ambulance Corporation and two ambulance personnel. Damages sought total 2 million including compensatory and punitive sums. The court left counts for wrongful death and negligence, with Good Samaritan defenses to be resolved at trial. No trial date set.
