High Court Rules On Cuba Travel
The Supreme Court ruled unanimously that a generally valid passport protects a citizen from criminal prosecution for traveling to Cuba without government authorization. The decision rejects that Congress made mere travel to Cuba a crime and upholds the state's power to bar travel to certain foreign countries without criminal penalties. Justice Fortas notes the State Department rules do not criminalize such travel and clarify that the passport is not a Cuba bound voucher for protection services. The high court had earlier held that the secretary of state can deny passports for Cuba travel.
