Music Licensing Ruling Affects Dance Hall Operators
Justice Emmett R. Bowlus rules in favor of the American Society of Composers Authors and Publishers in a case against Gilmer T. Castle Sr a Georgetown Pike operator. The court found Castle liable for $40 and costs for contracting to use music at his dance hall even if the orchestra did not perform. Similar cases cited from New York Baltimore and federal courts support the broad enforcement of paying for the privilege regardless of actual use. Benjamin B Rosenstock represented the American Society with Patrick M Schnaufer for Castle.
