Maryland Wins Tax Case Against Northern Central Railway
The State of Maryland scored a major victory in its tax dispute with the Northern Central Railway Company. The Supreme Court of the United States denied the railway’s claim that a 1880 act created an irrepealable contract shielding it from higher taxes, affirming a Maryland Court of Appeals ruling that the company owes increased taxes on gross receipts. The case centers on about $220,000 in back taxes and a 2 percent tax on gross receipts, replacing the company’s claimed 0.5 percent rate. Attorneys George R. Gaither and Louis E. McNamee led for the State. Bernard Osher represented the railway.
