County eyes court test over Rosenstock annexation
Frederick County commissioners said they may sue to block Frederick City plans to annex the 85 acre Rosenstock farm, arguing the move violates the county master plan, would burden taxpayers, create a donut hole, and hinder East Frederick growth with sewer, road and flood plain issues. The city scheduled a Sept. 3 hearing on owner J O N Jenkins bid. city officials counter that the county opposition is political and refuses cooperation on a shared comprehensive plan.

Frederick rezoning requests heard by county planners
Frederick planners heard three zoning cases and a request for an agricultural district at Winchester Hall. The commission denied the Masser rezoning of 3.67 acres citing conflict with the comprehensive plan and a covenant restricting buildings. May’s 4.04 acre request was approved after traffic and utility concerns were noted, while Garst’s 1.669 acre light industrial to residential was approved to allow a house for her son. Bernstein’s 34.188 acre agricultural to residential case was continued for further study, scheduled for fall.
