Military Rule In Hawaii Held To Be Invalid

Judge Delbert E. Metzger ruled martial law in Hawaii is invalid despite assertions by Admiral Nimitz and Lt. Gen. Richardson that it is essential for war prosecution. The decision voids civilian authority under martial law and frees Lloyd C. Duncan from imprisonment, with an appeal planned by the War Department. Richardson said invasion remains unlikely. Nimitz supported the policy. The ruling affects how violations in military zones are handled while military curfews stay in effect.
