Retrial Held Over Hagerstown Sewer Machine Suit
A retrial of the case by the mayor and council of Hagerstown against the J C Crooky Company of Martinsburg West Virginia over a trenching machine valued at 2500 dollars used for sewer work was heard before Chief Judge Hammond Urner and Judges Worthington and Peter. The court reserved decision. The case grows from September and November 1917 contracts for sewerage work, the city claiming the machine was to be held as collateral and later turned over, while the defendant argues the machine was removed prior to written notice and thus not owed to the city. Attorneys Hagner and Weinberg represented the city, Emmert and Rolback for the Brooks Company.
