Gas Case First Test Valuation of Franchise

Assistant Corporation Counsel W. P. Burr notes the United States Circuit Court decision in the Scent gas case is far reaching. He says the city still seeks a return on franchises not tied to legal investment and that the case will likely go to the Supreme Court after the decree, with seventeen volumes to print for the appeal. The judge’s opinions clarify that franchises may not be added to assets for a fair return, and the company seeks a substantial remedy on tangible and intangible assets including mains valued at 12 million dollars.
