No Anti Betting Test Prisoners Discharged in New Law

Two men arrested at Sheepshead Bay for verbal bets at the racetrack were discharged after Acting Kings County District Attorney Robert H. Elder allowed habeas corpus writs to be sustained. The court found the commitment papers inadequate under the anti betting legislation and the men walked free, noting the case tests the new law’s reach and technicalities. Additional arrests related to suspected pool room operations followed in nearby streets amid ongoing test cases and legal debate. Governor Hughes declined to comment on the dismissals, suggesting the matter bears on the law’s merits but was decided on technical grounds.
