Justice Steckler Rules Easements Pass With Land Sale

In a Special Term decision Justice Steckler held that all easements appurtenant to a parcel of land pass with the land to a purchaser. A sale of such easements to the elevated railroad after the bill of sale and before deed is deemed a fraud on vendees. The suit by Alfred H. Marvin against Simon E. Bernheimer arose from a 1898 contract for five lots on Columbus Avenue. The court ruled the owners of the land were the vendees from the contract date, and the vendors held for their benefit, so the easements must accompany the property.
