Gramophone Patent Suit Targets National Gramophone Co
Berliner Gramophone Company and United States Gramophone Company file a bill in equity in the U S Circuit Court to restrain the National Gramophone Corporation from using the word Gramophone in its corporate name and adverts. They seek accounting of profits and argue Seaman founded the National Gramophone entity to bypass a 1895 agreement and sell infringing Zonophone products. The suit names Seaman as a director and alleges fraud and misrepresentation to gain buying rights while evading exclusivity provisions. The case links to Berliner patents and related actions against Zonophone makers and other alleged infringers.
