Forced to Return Assets Sets Precedent in Bankruptcy Case

Judge Holt of the United States Circuit Court ruled that the National Discount Company must turn over 4700 to Robert Van Iderstine, trustee for A Fellerman & Son, makers of women's garments. The decision targets the practice of transferring accounts receivable to lenders in bankruptcy to shield assets from creditors. The Fellerman firm owed 35000 with 5000 assets. two days earlier they moved 7700 receivables to the National Discount Company, which collected 4300, with about 760 in commissions and interest. The trustee had little to show creditors. the Merchants' Protective Association backed the suit. The ruling stresses knowledge of the arrangement and the defendant's role in concealing assets from creditors.
