Lansing May 28 U P The state will appeal to the Michigan supreme court from Judge Harry B Keidan s ruling that a tax of 25 cents per gallon must be collected on wort under the malt tax act Attorney General Wilber M Brucker said today He has represented John S Hagerty secretary of state in the test case which led to the ruling The state has collected 30 cents on each five gallon container of wort believing only malt content was taxed The ruling makes wort and malt tax equal under Keidan s interpretation a home brew user would owe 1 25 while malt users pay 15 cents for the same brew The appeal will delay higher wort tax collection until the next legislative session as expected
