Annulled Marriage Not a Bar to VA Benefit Payments
Melvin T. Dixon of the Florida Dept. of Veterans Affairs says under Title 38 U.S. Code remarriage or a child’s marriage cannot bar VA benefits if the marriage was void or annulled by a court with authority to decree annulment. It does not matter if the marriage ended by death or divorce before the annulment decree or the claimant’s challenge. A separate divorce on other grounds does not affect restoration if the marriage was void or the decree came after the divorce. In void or remarriage cases, evidence must show the marriage was absolutely void under state law, not merely voidable, absent an annulment decree.
