Supreme Court limits land takings compensation in grazing land case
The Supreme Court ruled 5 to 4 that when the government condemns 920 acres in western Arizona for the Alamo Dam project it need not consider access to adjacent grazing land. Justice Rehnquist said government-created value, via grazing permits, is not owed as extra compensation, reversing lower courts. The decision reduces potential gains for rancher Chester Fuller, who had argued for $350,000 beyond the land value.
