Parochial Aid Tax Credits Ruled Invalid

A federal court in Columbus Ohio held unconstitutional an Ohio law that would have given parents of parochial school students 90 dollars per pupil per year as tax credits. The ruling confirms a second defeat for lawmakers seeking to bypass constitutional limits. The decision names U S District Judges Carl Rubin Joseph Kinneary and John Peck and was welcomed by American Civil Liberties Union of Ohio leader Benson A Wolman. The case was brought by Tax Commissioner Robert Kosydar against Wolman. The state planned to appeal. Governor John J Gilligan had no comment. The legislature had previously moved to circumvent courts in 1971 citing similar Rhode Island and Pennsylvania cases. Rep Norman A Murdock authored the bill allocating 61 million in the current budget as direct grants to parochial school parents.
