State Court Rejects Damages over Tavern Beer Sale to Driver
The Wisconsin State Supreme Court ruled that a tavern keeper who sold beer to a minor cannot be liable for damages in an auto crash after the minor leaves the tavern. Farmers Mutual Insurance sought $2,500 from Carl Gast, who served the 17 year old Donald Kahler on Feb 13, 1958, and whose car struck a tree injuring a girl. Justice Currie said the claim challenges the common law link between negligent sale and intoxication.
