Beer Definition in South Dakota Case Reversed
Judge Fuller in State of South Dakota v Sioux Falls Brewing Co rules that beer is not necessarily intoxicating without evidence. It holds that without a statute declaring beer intoxicating, mere purchase or sale of beer cannot prove intoxication. The decision notes varieties of beer, including non malt types, and reverses lower court findings.
