Fight on Cigarette Law challenged in municipal court
Attorney T J Spangler argued before Judge W M Herbert that the South Dakota anti cigarette statute is unconstitutional for its entitling clause. He contends the law does not specify offenses the act aims to prohibit, a point that could strike down the ban on selling cigarettes statewide. The case arose when A F Scharnweber was charged with selling cigarettes and waived jury trial. The Michigan supreme court recently ruled a similar law unconstitutional.
