Middletown judge rules in favor of Kittyhawk on zoning

Common Pleas Judge Fred B. Cramer finds C2 versus C3 zoning distinctions void as to the shopping center project. Kittyhawk Investments plans a $3 million, 150000 square foot center on Lewis Street east of Breiel Boulevard, with Esco Distributing set to open today. Miles Fabric Center and Esco operate outside C2, while Middletown Shopping Plaza nearby is C3. The ruling emphasizes reasonableness of zoning and equal protection concerns.
