State Board Refuses To Rule In Case
COLUMBUS RP The State Board of Tax Appeals ruled it has no jurisdiction to decide an appeal by National Tube Company of Lorain against a 99808 tax assessment The board said it is an Appellate Board and the case must first be heard by the Board of Revision of Lorain County The company a New Jersey firm operating in Lorain asked the board to declare two blast furnaces and other equipment personal property In an appeal filed July 14 1947 the company said its property had been over assessed by the Lorain County auditor over five years from 1942 to 1947 The auditor maintained the two furnaces and 80 feet of 12 inch pipeline were omitted from the real property tax duplicate The company said the equipment was personal property and taxes were paid on it in its personal tax payments The firm based its contention on a 1937 Supreme Court decision in which similar equipment belonging to Standard Oil Company was declared personal property
