Obama remarks spark a wave of sexual assault case challenges
As President Obama called for aggressive penalties against sexual assault in the military, judges and defense lawyers say his remarks amount to unlawful command influence. In at least a dozen cases from Shaw Air Force Base to Fort Bragg and beyond, motions to dismiss and delays cite his words as tainting juries and proceedings. Military law experts note the president’s use of dishonorable discharge as a strong cue, while officials emphasize he did not prescribe punishments.
