NLRB Upholds Firing Of 89 Foremen In 1946 Strike
The National Labor Relations Board ruled that Carnegie-Illinois Steel Company did not violate the Wagner Act by discharging 89 foremen who refused maintenance work during the 1946 steel strike. In a 3-2 decision, the board found the foremen had breached their duty, justifying removal from protection. Most dismissals occurred in March 1946 at the Gary Indiana plant where the Foremens Association of America members worked. The strike was led by CIO United Steelworkers of America. The majority noted the plant could have suffered $70 million in furnace damage if all workers abandoned the site.

Company discharges supervisors over strike loyalty
The court upheld firing foremen who refused to report during a strike, saying the firm could rely on supervisors able to prevent plant damage in emergencies. A dissent argued the plant threat stemmed from management’s CIO maintenance offer rejection, not foremen duties, and that foremen weren’t asked to do strikers’ work.
